Empaths Running the United States

I found this description of Empaths: those who have the ability to scan another's psyche for thoughts and feelings or for past, present, and future life occurrences. I can see how this would definitely be an important trait in a future Supreme Court Justice.
In fact, we should only appoint Judges or impanel juries who can boast that they are more swayed by emotion than by reason or evidence. Of course we may have to remove that evidentiary stumbling block, the right to confront one's accusers since one cannot confront emotional evidence.
Imagine this case before bar: a murder defendant presents irrefutable exculpatory evidence including a video tape showing that he was a contestant on American Idol during the time of the crime along with a confession from the real killer admitting to the murder along with a dozen witnesses attesting to that fact.
On the other hand, the prosecution, lacking any real evidence to convict, instead relies on the availability of unlimited prosecutorial funds to fashion a moving, tearful collage of music, still pictures from the victim's youth, heart-rending music, professional narration by a well-known sympathetic actor, and Hollywood motion video.
In such a case, the prosecution will easily sway jurors' sympathy for the victims and increase their loathing for the defendant. Now isn't that what we want from the Justice system, empathy?
It is amazing how Obama can so easily destroy in less than a few months the foundations of our entire legal system and that of the English speaking world built over the last 800 years. Who needs Liberty and Justice when we can have Empathy?
